ASML US, including its affiliates and subsidiaries, bring together the most creative minds in science and technology to develop lithography machines that are key to producing faster, cheaper, more energy-efficient microchips. Role and responsibilities
The Senior Patent Counsel will be performing a wide range of IP management and patent law functions arising within ASML US Inc. and Cymer Inc. (collectively referred to as the "Company") to ensure strong IP protection and risk mitigation for the Company. This position is based in San Diego reporting to the Senior Patent Counsel Team Leader of the Patents EUV / CLS group, which group is part of the Netherlands-based Corporate Intellectual Property group ("CIP").
This position requires access to controlled technology, as defined in the Export Administration Regulations (15 C.F.R. ยง 730, et seq.). Qualified candidates must be legally authorized to access such controlled technology prior to beginning work. Business demands may require ASML to proceed with candidates who are immediately eligible to access controlled technology.
- Coordinate various aspects of the Company's patent filing program with CIP, including review and selection of invention disclosures for which patent protection will be sought. Additionally this position will provide intellectual property law guidance, including freedom to operate advice, to Company scientists, engineers, and management.
- Overseeing the preparation and prosecution of patent applications in the U.S. Patent Office and internationally.
- Assess patent and other IP positioning of competitors (i.e., freedom to operate).
- Lead and oversee outside counsel consistent with Company objectives and operating guidelines to e.g. properly prepare and prosecute patent applications in assigned area(s) of responsibility.
- Support execution of Company IP strategies including patent filing and product clearance. Make recommendations to protect innovations developed in research, incubations, and invention harvests.
- Evaluate third party patent infringement claims against Company subject matter areas of interest including research, products, or technologies.
- Occasionally assist with advising or structuring and/or negotiating in-bound or out-bound patent licenses as directed and/or requested by CIP and/or Company management.
- Conduct and/or direct administrative staff in the conduct of legal research directed to resolving legal and/or procedural issues encountered in the advancement of, or challenges to, Company intellectual property assets.
- Perform other duties as assigned.
Education and experience
- Juris Doctorate (J.D.), from an accredited law school with excellent academic performance.
- Bachelor's Degree in the engineering or physical sciences disciplines such as electrical, mechanical, systems and controls science, physics, materials, or optics.
- Master's degree a plus.
- 6+ years of relevant patent experience.
- Must be licensed to practice law in at least one U.S. state or the District of Columbia.
- Must be licensed to practice before the United States Patent Office.
- Experience with physics, preferably optics, a plus.
- Experience in managing outside counsel.
- Ability to render compelling written descriptions and arguments along with graphic explanatory devices.
- Excellent client/customer service ethics and skills, with an advanced understanding of client relationship-building.
- Ability to draft and file patent applications in a cost efficient manner.
- Proficient ability to plan and direct administrative staff and others in activities supporting the Company's legal work and objectives.
- Broad technical knowledge, familiarity with all relevant technologies.
Skills

- Ability to translate and statistically analyze data, and effectively report problems through written and/or graphic formats.
- Ability to use MS Word, Excel, PowerPoint, and electronic e-mail systems, as well as on-line research tools.

- This position is located on-site in San Diego, CA. It requires on-site presence to attend in-person work-related events, meetings and to further ensure teamwork, collaboration and innovation.

The current base annual salary range for this role is currently $165,750-$276,250. Pay scales are determined by role, level, location and alignment with market data. Individual pay is determined through interviews and an assessment of several factors that that are unique to each candidate, including but not limited to job-related skills, relevant education and experience, certifications, abilities of the candidate and pay relative to other team members.
