ATTORNEY ADVISOR (LABOR)

Job Description

Summary The primary purpose of this position is to legally represent parties in Federal District Courts, Federal Appellate Courts, the US Supreme Court and State courts. This position also independently represents the AF, AF units, commanders, managers, employees and members in a wide variety of legal administrative forums, to include the Merit Systems Protection Board, the Office of Special Counsel, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, etc. Duties Serves as a senior attorney for litigation in Federal Courts involving the AF with responsibility for planning and accomplishing diversified legal work pertaining to litigation matters arising out of AF civilian personnel and labor matters. Duties relate to the protection of equal employment opportunity and the civilian personnel policy interests of the AF. Is lead counsel and defends the AF world-wide at all command levels in administrative litigation of cases before the FLRA, EEOC, MSPB, FSIP, FMCS, OSC, federal sector arbitrators, state Unemployment Compensation agencies, state Worker's Compensation agencies and officials directed to adjudicate grievances through the Agency Grievance Procedure. Advises at the Secretary of the AF, Chief of Staff level, Air Staff level, Senior Program managers and MAJCOM level personnel on the development of HQ USAF-level policy relating to personnel matters. Interprets and develops or prepares interpretative and administrative positions. Assists in interpreting and developing HQ USAF directives and regulations in the area of federal employee and labor law. Trains judge advocates, civilian attorneys, paralegals, personnel specialists, equal employment opportunity specialists, commanders, managers, and supervisors on all aspects of labor and employment law to ensure observation of regulations, law and the constitution. Attorney appointments are subject to serve a one-year probationary period. Candidates are not required to have active duty service or veterans’ preference to be referred and considered. Depending on the type of position (competitive/excepted) you are selected for, you will be required to serve a 1-year probationary period OR 2-year trial period. Upon completion of your probationary/trial period, your employment will be terminated unless you receive certification, in writing, that your continued employment advances the public interest. Employee must be able to obtain and maintain a secret security clearance as a condition of employment. This is a centrally managed position. Leave accrual may be authorized upon request. Advance in hire may be authorized if there is demonstrable proof on your resume. Must be available for temporary duty travel by military or civilian aircraft. Overtime may be required. Qualifications GENERAL REQUIREMENTS: You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). In addition, at the time of application, you must provide proof, dated within four months of application of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Specialized Experience: In addition to the basic requirement: you must have professional legal experience in excess of three (3) years that commensurate with the position's duties and responsibilities. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: In depth knowledge of the Federal Labor Management Relations Statute and related statutes and regulations, and FLRA case law, Federal Court case law interpreting the statute, and DoD/AF issuances implementing them and in depth knowledge of the Title VI, ADEA, Rehabilitation Act and other anti-discrimination laws and the Federal Regulations associated with those laws, EEOC case law, EEOC Management Directives, Federal Court case law interpreting the statutes, and DoD/AF issuances implementing them. In depth knowledge of the statutes governing the MSPB, implementing regulations, MSPB case law, Federal Court case law interpreting the statute, and DoD/AF issuances implementing them and in-depth knowledge of Federal Rules for Civil Procedure, and litigation techniques necessary for the defense of the AF in administrative and judicial forums. In depth knowledge of other administrative forums in which the LLFSC practices such as the FSIP, MCS, OSC, etc., and knowledge of DoD and AF structure and chain of command. Ability to defend the AF before administrative and judicial forums and ability to supervise and lead other attorneys responsible for handling Federal defensive litigation. Ability to perform legal research using electronic and traditional means and ability to gather facts and effectively evaluate and analyze them to develop evidence to support AF litigation positions. Skill in communicating both orally and in writing and ability to establish work priorities and delegate tasks. PART-TIME OR UNPAID EXPERIENCE: Credit will be given for appropriate unpaid and or part-time work. Volunteer work helps build critical competencies, knowledge and skills that can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Education Must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth. The attorney must maintain such bar membership in at least one jurisdiction during the entire course of employment with the Air Force.
