Summary
The Deputy General Counsel (Fiscal) position is in the Office of General Counsel (OGC). The General Counsel of the Department of War (DoW), who is appointed by the President by and with the advice and consent of the Senate, is the chief legal officer of the Department of War and principal legal advisor to the Secretary of War, with final authority and responsibility for establishing the Department's position on legal matters and delivering legal services throughout the DoW and its components.

Duties
Major duties and responsibilities include, but are not limited to:
Provides legal advice and services to the Under Secretary of War (Comptroller) and his or her office and other Principal Staff Assistants within the Office of the Secretary of War on matters involving federal appropriations law and the Department's exercise of its comptrollership and financial management authorities and responsibilities and, in coordination with the General Counsel, Department of War, provides legal counsel to the Secretary of War and the Deputy Secretary of War on such matters.
The Under Secretary of War (Comptroller) relies upon the Deputy General Counsel (Fiscal) for assistance in developing the Department's financial management policies and in executing the Department's budget. The incumbent is consulted and actively participates in developing and ensuring the legal sufficiency of all OUSD(C) issuances regarding such matters.
Incumbent reviews directives, instructions, regulations, and all significant correspondence pertaining to his or her area of responsibility for legal sufficiency and ensures that such documents are revised as necessary.
Incumbent also reviews for legal compliance with federal appropriations law, all such papers referred to the Under Secretary of War (Comptroller) for his or her approval or concurrence.
Incumbent furnishes legal advice and assistance on questions that arise during the formulation, presentation, and execution of the DoW portion of the President's annual budget submission, providing counsel to the Under Secretary of War (Comptroller) and
key members of his or her staff.
The incumbent reviews for the Under Secretary of War (Comptroller):
The DoW Legislative Program items having a fiscal impact to establish and present the views of the Under Secretary of War (Comptroller) and provide the basis for integration of the Legislative Program within the budgetary plans and policies of the DoW.
Emergency legislation having a fiscal impact.
Bills introduced in Congress and referred to the Under Secretary of War (Comptroller) for review and comment.
Directly responsible for reviewing the legal sufficiency of Do W' s financial implementation of all statutes relating to the Department, as well as for the proper implementation of the general provisions of the annual DoW Appropriations Act.
Renders advice and legal opinions on matters that impact virtually all substantive and operational programs of the Department of War, because requirements regarding the use, control, and accounting for funds directly or indirectly influence the nature, scope, and methods of conducting DoW business at all operating levels.

All newly appointed Career SES leaders must sign the Reassignment Rights Obligations Agreement as a condition of appointment into the SES.

In order to qualify for this position, you must be able to obtain a Top Secret security clearance and access to Sensitive Compartmented Information (TS/SCI).

The individual selected will be required to file an 'Executive Branch Personnel Financial Disclosure Report (OGE-278) in accordance with the Ethics in Government Act of 1978.

TECHNICAL QUALIFICATIONS (TQs): Your resume should demonstrate accomplishments that would satisfy the technical qualifications:
TQ 1: Comprehensive knowledge of and demonstrated experience in the following legal program and practice areas: federal appropriations law, including fiscal aspects of foreign assistance authorities such as the Foreign Assistance Act and Arms Export Control Act, as well as the constitutional and statutory provisions pertaining to the use of appropriated funds; Department of War financial management policies, regulations, and practices.
TQ 2: Experience managing attorneys and/or a multifaceted legal office with demonstrated ability to manage complex programs or activities, problem-solving under challenging circumstances, and reconciling diverse views to accomplish program objectives.
EXECUTIVE CORE QUALIFICATIONS (ECQs): In addition to the Technical Qualification Requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs. If your 2-page resume does not reflect demonstrated evidence of the ECQs and TQs, you may not receive further consideration for the position.
There are five ECQs:
ECQ 1: Commitment to the Rule of Law and the Principles of the American Founding - This core qualification requires a demonstrated knowledge of the American system of government, commitment to uphold the Constitution and the rule of law, and commitment to serve the American people.
Sub-Competencies:
Knowledge of the American System of Government: Demonstrates understanding and appreciation of the American system of government, including the Constitution, the Bill of Rights, separation of powers, federalism, and the historical development of the American Nation.
Commitment to the Rule of Law: Upholds the principles of the American Founding, including equality under the law and democratic self-government. Ensures the law is applied fairly and consistently.
Civic-Mindedness: Stays up-to-date on important developments in American government and aligns organizational objectives and practices with presidential and public interests. Demonstrates a commitment to serve the American people.
ECQ 2: Driving Efficiency - This core qualification involves the demonstrated ability to strategically and efficiently manage resources, budget effectively, cut wasteful spending, and pursue efficiency through process and technological upgrades.
Sub-Competencies:
Fiscal Responsibility: Strategically manages, allocates and monitors financial resources. Aligns priorities and initiatives to justify budget proposals. Monitors expenditures, cuts unnecessary costs, and uses cost-benefit analysis to set priorities.
Managing Resources: Manages resources efficiently and effectively based on current and projected organizational goals, skills, budget considerations, and staffing needs.
Leveraging Technology: Explores emerging technology and potential applications. Incorporates technology to enhance efficiency and achieve results. Ensures access to and security of technology systems.
ECQ 3: Merit and Competence - This core qualification involves the demonstrated knowledge, ability and technical competence to effectively and reliably produce work that is of exceptional quality.
Sub-Competencies:
Technical Skill: Possesses the requisite technical knowledge and subject matter expertise to consistently produce timely, high-quality work. Is considered a strong contributor in his or her domain.
Problem Solving: Engages in critical and data-driven thinking when diagnosing root causes and evaluating options. Identifies and promptly addresses the most pressing, high-priority problems.

ECQ 4: Leading People - This core qualification involves the demonstrated ability to lead and inspire a group toward meeting the organization's vision, mission, and goals, and to drive a high-performance, high-accountability culture. This includes, when necessary, the ability to lead people through change and to hold individuals accountable.
Sub-Competencies:

Education
Candidates must meet the following education requirement for career series 0905:
Must be a graduate of law school. You must have a current license to practice law from at least one state, the District of Columbia, or a U.S. commonwealth or U.S. territory, and be able to demonstrate that in a least one state or jurisdiction in which you are licensed you are permitted to engage in the active practice of law. Active status must be maintained in at least one state or jurisdiction during the course of employment in the Office of the General Counsel.
Applicants are not required to provide an official certificate demonstrating this active status, but must provide such a certificate to the selecting official if selected.
A certified copy of a law school transcript is required as proof that you meet the educational requirement for this position (unofficial transcripts are acceptable at application stage) and must be provided to the selecting official if selected. Failure to provide a copy of your transcript for this announcement will result in a rating of "ineligible."

DoD Joint Enterprise-Wide Experience Statement: In addition, DoD requires an Enterprise Perspective. This individual must have the ability to apply a broad point of view and an awareness and understanding of individual or organizational responsibilities in relation to DoD or government-wide strategic priorities is required.
