Summary The Division of Investment Management's Rulemaking Office is seeking a Supervisory Attorney-Adviser (Private Funds Branch Chief) in the Investment Adviser Regulation Office. As a Branch Chief, you will lead policy development for private fund advisers, oversee complex rulemakings, provide interpretive guidance, supervise attorneys, and advise Commission staff and leadership on key regulatory initiatives. Learn more about this agency Duties In this role as a Private Funds Branch Chief, you will be responsible for: Analyze and interpret federal securities laws and Commission rules governing investment advisers and investment companies, including private fund advisers and private funds, to assess the need for new rules or amendments; develop policy recommendations; draft proposing and adopting releases; formulate interpretive positions; and contribute to strategic approaches for advancing the Commission's regulatory objectives. Lead and manage rulemaking initiatives, including with respect to private fund advisers and private funds, from concept development through Commission consideration and approval, ensuring compliance with the Administrative Procedure Act and integrating legal, economic, and policy analyses throughout the process. Draft work products and provide rigorous review and editorial guidance on rulemakings, staff guidance, and other written materials prepared by team members. Advise the Commission and staff across the agency, including in Enforcement, Examinations, and Disclosure Review, on issues involving the regulation of investment advisers and private fund advisers, and on the disclosure of information by investment advisers and private fund advisers. Perform supervisory duties, including setting performance expectations, providing feedback, managing training, awards, and recruitment; and communicate policies, procedures, and goals to staff. Communicate with the Division Director, Associate Directors, and internal and external stakeholders on the status, progress, and key developments related to rulemaking matters. SUPERVISORY TRIAL PERIOD: This appointment may require completion of a two year supervisory/managerial trial period. TRIAL PERIOD: Consistent with 5 U.S.C. ยง 7511, you will be required to serve a two-year trial period (one year for preference eligible veterans) if the position to which you have applied is not the same or similar to your current position of record. You must possess a J.D. or LL.B Degree and you must be an active member of the bar in good standing. BASIC REQUIREMENT: All applicants must possess the following: J.D. or LL.B. degree --AND-- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement. SK-15: Applicant must have three years of post J.D. work experience independently identifying legal issues, providing legal analyses, providing legal solutions/recommendations, and preparing legal documents such as contracts memoranda, and disclosure documents, which also includes two years: Providing legal guidance on issues arising under the federal securities laws, including interpreting statutes, rules, and regulations; Conducting legal research and developing interpretations of statutory and regulatory provisions; and Applying the requirements of the Investment Advisers Act, Investment Company Act, Securities Act, and Exchange Act.
