The Assistant General Counsel, Privacy and Technology will oversee all ongoing activities related to the development, implementation, maintenance of, and adherence to Amplify's policies and procedures covering the privacy of, and access to, sensitive data collected, stored and used by the company in compliance with federal, state and local laws, as well as those arising from Amplify's policies and contractual obligations. The successful candidate will also be responsible for drafting, negotiating and advising on a range of technology transactions, including software licenses, SaaS agreements and technology services agreements.
This role will report to the General Counsel, but commensurate with experience, will be expected to take ownership of the legal aspects of the privacy function and work closely with key stakeholders to develop and maintain a culture of regulatory excellence around privacy matters. Externally, this person will liaise with relevant federal, state and local government agencies and customers.
Amplify's COVID-19 vaccination policy requires all staff to provide proof of vaccination for in-person meetings unless an approved exemption is provided.
Key Responsibilities
  • Provide development guidance and assist in the identification, implementation, and maintenance of Amplify's data privacy policies and procedures in coordination with the company's leadership, Information Security Committee, product, technology, sales and marketing teams
  • Perform initial and periodic information privacy risk assessments and conduct related ongoing compliance monitoring activities in coordination with the company's other compliance and operational assessment functions
  • Review and negotiate data processing agreements for customers and vendors
  • Oversee, direct, deliver, and ensure delivery of data privacy training to all employees and appropriate third parties
  • Establish and administer a process for receiving, documenting, tracking, and taking action on requests from schools to provide parents or eligible students with a means to inspect, review, and request changes to student data held by Amplify on behalf of its school customers
  • Facilitate creation and monitor practices to ensure that data privacy principles are embedded in Amplify's products
  • Review all information security plans throughout the company's divisions to ensure alignment between security and privacy practices, and act as a liaison to the Information Security Committee, including close coordination with the Chief Technology Officer
  • Work closely with company personnel who have access to and / or handle sensitive data to ensure full coordination and cooperation under the company's policies and legal and contractual requirements
  • Maintain current knowledge of applicable federal and state privacy laws and regulations, and monitor advancements in data privacy best practices to ensure organizational adaptation and compliance
  • Support company M&A initiatives, including diligence and integration efforts specific to privacy and data protection
  • Work with company's leadership, Information Security Committee, and other stakeholders to represent the company's data privacy interests with external parties (including federal, state or local government bodies) who undertake to adopt or amend privacy legislation, regulations, or standards.
  • Draft, negotiate, and advise on a range of technology transactions, including software licenses, SaaS agreements, and technology services agreements.
  • Provide legal support for technology projects, including procurement of software and hardware, and technology infrastructure.
  • Stay up to date on relevant technology trends and developments to support these responsibilities

Basic Qualifications:
  • JD from ABA-accredited law school and current membership in a state bar.
  • Minimum 5 years of relevant privacy and transactional experience, either in a law firm, in-house legal department or legal organization
  • Working knowledge of data privacy laws and regulations with the ability to act as a subject-matter authority in privacy
  • Ability to distill down for laypeople the complexities arising from the interplay between applicable privacy laws
  • Experience with privacy and security provisions in commercial agreements
  • Experience negotiating technology contracts
  • Excellent written and verbal communication and presentation skills
  • Proven ability to work independently while mindful of guidelines and requirements set by senior management
  • Proficient organization skills and the ability to keep track and follow up on multiple issues, risks, and tasks

Preferred Qualifications:
  • IAPP or similar certification
  • Familiarity with FERPA, COPPA and state laws relevant to education and youth privacy
  • Experience working in education or education technology

The gross salary range for this role is $230,000- $250,000. This role is eligible to receive an annual discretionary bonus that rewards individual and company performance.
