Position Overview
Outset Medical, Inc. is seeking an experienced director level Associate General Counsel, Privacy to support the development and management of our privacy program and provide advice and support of data privacy and information security matters. The position will report to the AGC & VP, Privacy & Compliance.
We are flexible with respect to geographic location. The ideal candidate will be comfortable working remotely from home within the US or from our HQ office in San Jose, CA.
Essential Job Functions and ResponsibilitiesÂ
- Develop and maintain subject matter expertise in areas of data use and protection laws in a healthcare setting (including state and federal privacy laws, CCPA, and HIPAA).
- Monitor developments in laws & regulations and assess impacts on the Company’s ongoing privacy compliance.
- Work with the information security team and other key stakeholders to maintain and grow the data privacy and information security governance program, including drafting and updating relevant internal privacy and data security policies and procedures.
- Partner with other Outset business functions to support the execution of key initiatives, ensuring privacy compliance strategies are embedded.
- Support the development and management of effective training and communication in support of Outset’s privacy program.
- Support incident preparedness and response activities
- Support risk assessment activities to facilitate the identification of areas of potential vulnerability and risk and support the development & implementation of corrective action plans to strengthen privacy compliance.
- Draft, review, and help negotiate privacy and data protection-related provisions in complex commercial contracts and standalone contracts (e.g., Data Privacy Addendums and Business Associate Agreements).
- Work closely with digital marketing and product teams to guide privacy-forward product development and evaluate the impact of privacy laws and enforcement actions.
- Support the timely and efficient handling of inquiries and requests (including but not limited to complaints, consumer rights access requests, opt-outs, and requests for accounting of disclosure).
- Advise internal stakeholders on privacy legal matters, including areas related to partnerships, acquisitions, integrations, and other business development opportunities.
Requirements/Qualifications
- J.D. degree (or foreign equivalent) and member in good standing of at least one US state bar.
- Minimum of 7 years of progressive legal experience in a law firm and/or in-house setting.
- Experienced with US healthcare privacy and information security risks and mitigations.
- Strong knowledge of US privacy laws, regulations, and healthcare industry guidelines. Knowledge of international privacy laws, including those relevant to international data transfers and research, a plus.
- Working knowledge of developing legal and ethical landscape related to artificial intelligence.
- Experience conducting data protection impact assessments and vendor privacy assessments and responding to consumer rights requests.
- Experience drafting and reviewing policies and procedures and developing privacy training materials.
- Strong business acumen with excellent client counseling experience.
- Experience working cross-functionally to advance projects in a multi-stakeholder environment.
- Ability to think quickly and creatively and prioritize workloads to align with business priorities.
- Ability to operate autonomously while being a team player who brings a positive attitude to the workplace.
- Excellent oral and written communications/presentations, influence and persuasion, facilitation, and teamwork skills.
- Ability to travel up to 20%.
Desired Qualifications
- IAPP Certification (e.g., CIPP/US, CPIM, CIPT, FIP)
- Strong knowledge of the healthcare business & regulatory environment at the US federal & state level: Anti-Kickback Statute, False Claims Act, Sunshine Act / state transparency reporting requirements, including relevant Office of Inspector General (OIG) Model Guidance & applicable Advisory Opinions, as well as knowledge of the FCPA, conflicts of interest, gifts & entertainment & similar issues

SF Bay Area Salary Range
$210,000—$240,000 USD
