The Legal Affairs and Claims Group in MIGA (known as "MIGLC") serves as the legal counsel for MIGA, and provides legal advice relating to the governance, operations, and other activities of the Agency. Among its principal responsibilities, MIGLC advises MIGA's Council of Governors, Board of Directors and senior management, negotiates and drafts contracts of guarantee, manages all claims proceedings, facilitates discussions between investors and governments related to disputes and potential claims, oversees outside counsel, supports MIGA's internal departments in risk and policy analysis, finance and risk management and external outreach, and promotes innovation and knowledge sharing in support of MIGA's mission.

Roles and Responsibilities

The Chief Counsel reports to the Director and General Counsel and the duties and responsibilities entail a wide range of activities relating to operations, pre claims and claims, policies and corporate matters, including:

  • People/ Talent Management
    • Manage the unit staff, including the recruitment, coaching, results agreement, performance evaluation (addressing any performance gaps and course corrections) and career development guidance.
    • Promote a culture of effective teamwork, inclusiveness and collaboration.
  • Resource Management
    • Manage the unit's resources for the delivery of the work program. Resources include staff, administrative budget, and consultants.
  • Knowledge Management
    • Facilitate consultation and peer-to-peer discussions among MIGA colleagues and external parties as relevant to responsibilities.
    • Ensure systematic sharing of good practice and learning from lessons from within MIGA and partners.
  • Technical Expertise
    • Strategize and manage pre claim matters and the claims process in close consultation with the General Counsel. Advise clients, discuss with government officials, and facilitate discussions amongst all parties in pre claim matters.
    • Provide clearance for and supervise the drafting and negotiation of contracts of guarantee and ancillary documents. Advise on transaction structures, including eligibility under MIGA's governing documents, subrogation rights and rights of recovery, and other legal issues. The Chief Counsel is responsible for the successful and timely delivery of legal work.
    • Assist project attorneys and operational teams in resolving legal, policy and deal structuring issues associated with complex or novel operations or products, providing innovative and creative advice, while protecting the Agency's interests.
  • Lead counsel meetings in an effective manner, providing intellectual and operational leadership.
  • As delegated, supervise policy and institutional matters.
  • Representing MIGLC and participating effectively in the MIGA Extended Leadership Team.
  • Act on behalf of the General Counsel when she/he is away from the office.

Selection Criteria

  • Minimum: Juris Doctor, LLB, or equivalent law degree; qualification to practice law in at least one jurisdiction.
  • At least twelve years of relevant legal experience since earning law degree. Relevant experience includes legal work and advising in private sector emerging market transactions, involving cross-border lending, international project or corporate finance or political risk, export credit or investment insurance.
  • Track record of leadership and contributions in political risk insurance and credit enhancement operations.
  • Strong client service orientation: demonstrated history of having been able to work under pressure and respond to demands from internal and external clients in a timely fashion.
  • Strong negotiation skills and diplomacy, high degree of discretion, ethics, tact, and sensitivity in handling confidential and sensitive matters.
  • Demonstrated track record of effectively managing, mentoring and guiding diverse teams.
