Complex Claims Consulting Director - Environmental & Mass Tort Claims

Individual contributor responsible for the overall management of the most complex, high exposure claims in the Environmental & Mass Torts Claims (EMTC) group. Recognized as the most senior technical expert, working on complex, high exposure claims (e.g. sexual molestation, environmental, sports-related concussions, talc, glyphosate, lead paint, etc.). In conjunction with senior level management, works within assigned limits of the broadest authority on assignments requiring the highest degree of technical complexity and coordination. Has national or company-wide scope of responsibility within specialty area.

Essential Duties & Responsibilities
Performs a combination of duties in accordance with departmental guidelines:

• Handles the most complex commercial claims, which are generally multi-year with significant potential loss exposure by managing and overseeing all aspects of the claim handling, including coverage determinations, investigations, liability, compensability and damages, pursuit of risk transfer, negotiations and litigation management.
• Analyzes data and facts throughout the lifecycle of claim to develop and implement appropriate resolution strategies
• Ensures appropriate and efficient claim management by effectively managing expenses and loss costs on major claims/accounts.
• Directs all types of investigative activity or litigation on major claims and ensures adequate and timely reserves are set. Consults and collaborates with inside and outside counsel regarding liability and coverage issues and strategies.
• Directs and may engage in the negotiation of the most complex settlement packages to drive cost effective and timely resolution. Attends complex multiparty mediations as the company representative.
• Actively pursues and identifies ways to improve operational efficiencies and quality in claims processes.
• Utilizes oral presentation and writing skills to escalate or efficiently communicate appropriate exposures to senior claims management, counsel, other carriers and other internal business partners, as needed.
• Keeps current on trends such as emerging claim types, newly developing exposures, potential media coverage, and state/federal legislation and regulations. May represent company in industry trade groups or other important events involving external business partners and clients.
• Regularly mentors and guides less experienced claims staff and other functional areas and assists with high exposure claims as needed. Could be called upon to serve as the company's representative in corporate depositions.
• Utilizes data and develops metrics to assist management in identifying emerging issues and trends that may have substantial impact on CNA claim (management) practices and processes Makes recommendations to and participates with senior management and business leaders in the development and implementation of claims policy and business strategy, contributes to the development of claim training, and is responsible for special projects and presentations.

May perform additional duties as assigned.
Reporting Relationship: Typically Director or above.
Skills Knowledge & Abilities

• Demonstrates the highest level of technical expertise, claims resolution skill and knowledge of insurance and claims principles, practices and procedures, and the consistent ability to independently and properly review and analyze complex policies and coverage and conduct a thorough coverage investigation.
• Excellent verbal and written communication and presentation skills with demonstrated ability to effectively interact with all levels of CNA's internal and external business partners and customers. Able to articulate complex claim facts, issues and analysis in a concise manner in both informal and formal settings.
• Demonstrates excellent analytical and problem solving skills.
• Ability to exercise independent judgment to effectively evaluate and handle ambiguous, complex and challenging business problems, and ability lead and work effectively with insureds, defense counsel, other carriers and internal resources in the management of accounts.
• Ability to effectively partner with internal counsel as well as oversee/manage outside counsel, and demonstrated leadership in negotiations and in developing and implementing resolution strategies.
• Ability to achieve results by taking a proactive long-term view of business goals and objectives.
• Knowledge of Microsoft Office Suite and other business-related software and company systems.
• Ability to embrace change and value diverse opinions and ideas.
• Ability to prioritize and effectively manages multiple projects.

Education & Experience

• Bachelor's degree with Master's in a related discipline or JD preferred , or equivalent experience.
• Typically a minimum of 10 years related work experience such as claims or legal experience with proven track record of success.
• Environmental claims experience strongly preferred
• Must have or be able to obtain and maintain an Insurance Adjuster License within 90 days of hire, where applicable.
• Advanced negotiation experience
• Professional designations are highly encouraged (e.g. CPCU)
