Position Summary

Senior Counsel will be directly responsible for advising on compliance matters related to all matters Brookfield Properties Multifamily, including Fair Housing, Affordable Housing Compliance, Landlord Tenant law, and Fair Credit Reporting Act (FCRA). Senior Counsel will advise on related Multifamily Property operational matters. The associate will provide legal counseling on additional compliance matters and conducts employee compliance training programs. Senior Counsel will assist as needed on matters associated with property developments, property acquisitions and dispositions, financings and litigation. The associate will oversee the work of and collaborate with outside counsel on legal matters.

Essential Job Functions

1. Oversees outside counsel and directs strategy related to defense of the Company on certain litigation matters brought by administrative agencies (i.e. Federal and local fair housing agencies, HUD, state or local BBB, consumer affairs agencies, EPA and State departments of health) including answering complaints and participation in administrative law proceedings. Coordinates strategy with SVP Legal, outside counsel, management and leadership on more significant legal matters. (10%)

2. Oversees and co-counsels with outside law firms on non-routine landlord/tenant disputes, tenant evictions, collections and other Operations matters. Provides counsel to management and leadership and ensures that leadership's thoughts and strategy are effectively represented to outside counsel. (25%)

3. Maintains an advanced knowledge of regulations and laws that may affect current contractual arrangements or business strategies affecting Multifamily Management operations, advises management and business stakeholders regarding changes to such laws and regulations and provides legal counsel on new laws and regulations impacting the Company's multifamily properties. (10%)

4. Prepares, reviews, and updates legal documentation for Multifamily properties, including form leases and related lease documentation (applications, resident selection criteria, verification forms, handbooks, policies and standard operating procedures), including documentation for non-litigated resident disputes (MOUs, releases, settlement agreements) and web-based materials. Assists management and leadership in developing and executing new policy and procedure initiatives. (25%)

5. Provides counsel to management and leadership on compliance issues, media and social media issues, consumer law issues, tenant bankruptcy matters and environmental issues. (10%)

6. Develops and conducts employee compliance and training programs and webinars, including Fair Housing law training. Assists in processing and reviewing of reasonable accommodation requests made by prospects and residents including processing requests and related communications and correspondence. (10%)

7. Coordinates legal intern/extern program and supervises research of interns/externs on Multifamily operations matters (5%)

8. Assist as needed on matters associated with property developments, property acquisitions and dispositions, financings and litigation. (5%)

Work Experience

  • 5-7 Years: Knowledge of property management and landlord/tenant law - Required
  • 3-4 Years: Knowledge of Federal, State and local laws and regulations concerning multifamily properties (HUD, LIHTC, tax-exempt bonds, etc.), federal/state consumer laws, federal/state fair housing laws, federal/state civil rights laws (including Section 504 and ADA), federal/state utility laws and regulations, and environmental and telecommunications laws/regulations - Preferred
  • 3-4 Years: Knowledge of property management and landlord/tenant law - Preferred
  • 3-4 Years: Experience working in-house - Preferred
