Job Description

Modivcare is looking for a VP, Associate General Counsel to Modivcare's personal care, medical monitoring and meals business who will be an integral business partner to the organization supporting the personal care and medical monitoring business lines with a focus on day-to-day healthcare matters such as state and federal healthcare regulatory compliance, government investigations, litigation, labor and employment, negotiating vendor contracts and provider agreements, and development of new service offerings for personal care and/or medical monitoring related businesses. The position reports to Modivcare's Senior Vice President, General Counsel & Corporate Secretary.

The attorney should have regulatory compliance experience with the False Claims Act, Anti-Kickback Statute, Stark Law, Medicare exclusion and Civil Monetary Penalty (CMP) actions, antitrust laws, fraud and abuse knowledge to arrangements involving healthcare providers and contractual matters, HIPAA and privacy, and other regulations affecting healthcare clients. The successful applicant will have the ability to understand Modivcare's diverse business operation and requires a demonstrated ability to be proactive, exercise independent judgment, and manage multiple projects simultaneously. The ideal candidate brings a collaborative approach and the ability to build strong relationships with internal and external clients.

The ideal candidate would be located in the greater New York City area, PA, or Southern Ohio.


You will...
  • Proactively identify, analyze, and mitigate legal risks.
  • Manage multiple litigation cases and pre-litigation claims for personal care and medical monitoring business segments, which will involve a wide variety of matters in multiple jurisdictions.
  • Provide advice and counsel on labor and employment issues and assist standardizing processes, templates, and forms.
  • Partner with internal stakeholders to assist with compliance issues.
  • Look for creative approaches to providing or improving services that may increase efficiency and decrease cost.
  • Keep up-to-date with external market events, pressures, and regulations which may impact personal care and/or medical monitoring and assesses whether similar issues exist in the organization. Identify functional and organizational implications associated with major trends and design solutions to address risks.
  • Conduct legal research, interpret law, and determine applicability of new laws.
  • Assist with budgeting and forecasting numbers for litigation, investigations, and other related matters.
  • Assist with quarterly litigation reporting to Finance and Accounting teams, management, and external auditors.
  • Lead and manage the activities of outside counsel and coordinate internal efforts to meet litigation and investigations requirements.
  • Develop and review contracts and assist in a wide variety of contract negotiations and disputes with customers, vendors, and partners.
  • Support the Legal Department's contract management and administration process.
  • Provide timely, high-quality analysis and pragmatic advice on legal and business issues to internal clients.
  • Set strategy for, manage, and provide legal advice to senior leadership.
  • Drive change and execute on any lessons learned and best practices.

Education

  • Juris Doctorate degree from an accredited law school.
  • Active license to practice law in a jurisdiction Modivcare conducts business in.

Experience

  • 18+ years of relevant, broad-based healthcare legal experience gained in an in-house legal department or law firm.
  • Regulatory compliance experience with the False Claims Act, Anti-Kickback Statute, Stark Law, Medicare exclusion and Civil Monetary Penalty (CMP) actions, antitrust laws, fraud and abuse knowledge to arrangements involving healthcare providers and contractual matters, HIPAA and privacy, and other regulations affecting healthcare clients.
  • Experience with prioritizing and handling numerous competing demands in a high volume and fast-paced environment.
  • Demonstrated ability to independently move projects forward by gaining support needed from stakeholders across the company and working in a cross-functional role.
  • Highly proficient in Microsoft Office applications (Word, Excel, PowerPoint and Visio), Adobe Acrobat and Smartsheet and Google applications (Gmail, Drive, Docs, Sheets and Notes), as well as the ability to learn and use proprietary computer systems and databases.

Salary: $195,000 - $220,000 / annually
