Director Worksite Compliance

The Director Worksite Compliance oversees all ongoing activities related to the development, implementation, maintenance of, and adherence to the organization’s regulatory compliance policies and procedures.

Major Responsibilities and Essential Duties:
Compliance– Ensures compliance with federal and state statutes and regulations pertinent to all company jurisdictions.  Serves as company resource on regulatory matters.
- Provides development guidance and assists in the identification, implementation, and maintenance of organization’s Worksite compliance policies and procedures in coordination with organization management and administration. Serves as information privacy resource to the Horace Mann Privacy Officer.
- Performs initial and periodic compliance risk assessments and conducts related ongoing compliance monitoring activities.
- Works with legal counsel and management, key departments, and committees to ensure the organization has and maintains appropriate compliance practices and materials reflecting current organization and legal practices and requirements.
- Works closely with executives in Compliance and the Business Areas, and Third Party Administrators (TPAs) to correct any compliance deficiencies.
Analysis and Communication – Leads the analysis and subsequent communication of legislative changes in regulatory compliance. Analyzes and responds to regulatory compliance questions from all levels of company. Develops creative solutions to product issues with the objective of maximizing opportunities for profitability and minimizing compliance risk. Participates in developing, implementing, and maintaining the overall Worksite compliance program, including a program to educate and communicate the importance of compliance best practices. Represents Horace Mann and works collaboratively with Horace Mann’s Chief Compliance Officer and with compliance staff in all Horace Mann locations, as assigned.
Business Practice Coordination – Researches and recommends response to various issues of potential regulatory non-compliance, including but not limited to, privacy; fraud; OFAC and record retention violations. Develops and implements solutions to correct actions and prevent future issues. Directs responses to all Worksite regulatory complaints, inquiries and investigations originating from state and federal regulatory authorities. Coordinates responses for corporate reports and surveys to state regulatory authorities. Oversees agent appointments Worksite producers. Coordinates producer renewals and terminations for all Worksite lines of business. Maintains positive relationships with business partners.
Product Drafting and Review – Provides compliance perspective in the product form drafting and contract filing, negotiation, and approval process for Worksite products. Reviews applications, authorizations, advertising materials and other forms as requested for compliance with federal and state statutes and regulations. Provides compliance expertise in the development and implementation of new and enhanced policy form filing language to support new lines of business and marketing needs.
Training and Audits – Provides initial and continued training to company staff on new and existing legislation as requested or as needed to ensure compliance. Audits policies and procedures of external business partners and third-party administrators to ensure company compliance with federal and state statutes and regulations.
Fraud
- Maintains fraud plans. Ensures delivery of initial and annual fraud training and orientation to all applicable Worksite employees, volunteers, contractors, and applicable third parties.
- Initiates, facilitates, and promotes activities to foster information fraud awareness with company and related entities.
- Reports, exchanges information and provides assistance to local, state and federal authorities in the detection, investigation and prosecution of fraudulent activities.
Supervisory Responsibilities – responsible for supervising a subordinate staff of one or more exempt compliance specialists. Supervisory responsibilities include setting priorities and performance standards, evaluating performance and communicating performance assessment to the employee. Provides input and manages expenses based on the departmental budget. Maintain high performance team-based culture through effective performance management, career development, communication, and coaching of staff.
Education and/or Experience:Â
- Bachelor’s Degree or experience commensurate in insurance and regulatory environment required.Â
- Professional Certifications preferred.Â
- A minimum of ten years of progressively responsible professional experience in regulatory compliance matters relating to group or individual insurance coverage.
- Strong oral and written communication skills.
- Demonstrated organization, facilitation, and presentation skills.Â
- Attention to detail.
- Advance knowledge of insurance laws and regulations preferably in life and health/disability lines of business.
- Knowledge in privacy laws, access, and release of information.
- Strong ability to collaborate and resolve conflict.
- Individual must be proficient in Microsoft Excel; and Microsoft Word. Experience with legal research tools such as Lexis Nexis, Westlaw, or NILS a plus.
