The Role

As a senior member of the legal team, you will be responsible for regulatory and compliance matters arising for the Company concerning the provision of mental health and well being services through the company’s digital platform. This role will work closely with our clinical care, operations, and product/eng teams, but will collaborate with almost every function at the company. Reporting to the Associate General Counsel and Head of Compliance, this role will be a key advisor to the business.

This position is not eligible to be performed in Hawaii.

What You’ll Do
  • Lead efforts to build the regulatory and compliance functions, including driving projects to build internal structure and process for a growing company, as well as providing counsel to the company’s product development teams on how to develop products and features within the law and consistent with best practices  
  • Advise on anti-kickback, corporate practice, telehealth, and other state and federal legal regimes regulating the provision of health care services, particularly mental health and wellness
  • Manage international legal review in connection with the company’s international operations, including liaising with outside counsel, collaborating with the product, clinical care, ops, and engineering teams on implementing international legal requirements, working closely with other members of the legal and compliance team
  • Monitor US legislative and rule-making activities that could materially impact business objectives and, as appropriate, shape Modern Health’s legislative efforts and/or draft comments advancing Modern Health’s views
  • Follow developments in global regulatory laws and compliance practices and update Modern Health systems and processes as necessary to remain compliant with laws and act consistent with best practices
  • Become a thought partner to our clinical care and product teams on digital health matters as they develop products and features, and propose creative ideas as to how we can work within the law to provide amazing user experiences
  • Collaborate with the go to market teams to ensure that all customer-facing material presents our product and company fairly and accurately
  • Assess and prioritize regulatory and compliance risk areas and implement risk mitigation strategies, including by developing and operationalizing internal policies and procedures to support compliance representations and warranties 
  • Conduct audits of company processes to ensure compliance with company policies and procedures, as well as applicable federal, state, and non-U.S. laws
  • Assist in the design of and conduct training for company personnel, as well as develop playbooks, draft FAQs that support regulatory and compliance at Modern Health
  • Manage and conduct internal investigations
  • Contribute to the vetting of third-party service suppliers and ensure systematic escalation and vetting of “red flags”
  • Assist with the preparation of compliance reports for executive leadership and the Board
  • Collaborate closely with other members of the legal team to achieve common goals and objectives
Who You Are
  • 8+ years of regulatory and compliance experience at a healthcare or health technology company operating in a heavily regulated space, a mid to large-sized law firm, and/or in government
  • J.D. from a top law school and excellent academic credentials
  • Experience providing strategic guidance on healthcare regulatory matters, working with regulators, and developing approaches that satisfy regulatory objectives while also achieving clients’ business goals
  • Experience with and/or understanding of compliance issues confronting the healthcare industry or another heavily regulated industry, including prior experience in operationalizing a compliance program
  • Experience advising on product matters and launches in a highly regulated space. Experience working on product matters in health technology sector is a big plus 
  • Experience with international business operations and expansions 
  • Experience managing domestic and international outside counsel
  • Demonstrated knowledge and understanding of the requirements for effective compliance programs as set forth in OIG Guidance and the Federal Sentencing Guidelines
  • Ability to assess and prioritize risks, allocate resources, and effectively work with relevant stakeholders on plans to mitigate such risks 
  • Excellent organizational, project management, analytical, and problem-solving skills with attention to detail
  • Extremely strong written and oral communication skills with a persistent eye toward problem-solving
  • Adept at operating in a fast-paced, dynamic work environment, and managing competing priorities under demanding deadlines
  • Proven ability to work cross functionally and with upper management to achieve regulatory and compliance objectives with support from internal business partners
  • Demonstrated ability to quickly learn and excel in new or emerging areas
  • Admission to a State Bar in good standing
